Upenned policies

Terms of use

Effective August 9, 2026

These terms govern access to and use of Upenned. By creating or using an account, you agree to these terms and the Privacy Policy. If you do not agree, do not use the service or upload material.

Eligibility and accounts

You must be at least 18, legally able to enter an agreement, and permitted to use the service where you live. Provide accurate account information, protect your sign-in credentials, verify your email address, and promptly report suspected unauthorized access. You are responsible for activity performed through your account unless caused by Upenned's failure to use reasonable security.

Account registration is self-service. Reasonable account, upload, storage, and processing limits may apply and may change to protect reliability and fair access. Upenned does not currently charge users. Any future paid feature will disclose its price and additional terms before purchase.

What the service provides

Upenned stores private letter archives and can generate draft transcripts, translations, summaries, historical context, and connections among people, dates, and places. It is not a museum, records custodian, guaranteed backup service, or provider of legal, medical, historical, genealogical, or other professional advice. Keep the physical original and an independent digital copy of anything irreplaceable.

Your content and permission to process it

You retain ownership of rights you hold in uploaded material and your corrections. You grant Upenned a limited, nonexclusive permission to host, copy, secure, recover, analyze, display, transform, export, and delete that material solely to provide, protect, and improve the service for you. This permission ends when the material is deleted, subject to the stated recovery window and any retention required by law.

You represent that you have a lawful basis and all permissions reasonably needed to upload and process the material. Do not upload stolen correspondence, unlawfully obtained records, material subject to a duty of confidentiality you cannot waive, or content that infringes privacy, copyright, publicity, or other rights. Historical importance does not by itself eliminate those rights.

Acceptable use

You may not use Upenned to:

  • Upload malicious code or unlawful, exploitative, or intentionally harmful material.
  • Harass, threaten, impersonate, defraud, surveil, or expose another person.
  • Test, bypass, disable, or interfere with the service's security or safeguards.
  • Access another person's account or create accounts through unauthorized automation.
  • Reverse engineer the service except where applicable law expressly permits it.
  • Use AI output as verified evidence or professional advice without independent review.

AI output

Transcripts, translations, names, dates, relationships, locations, and historical context are machine-generated drafts and may be inaccurate or omit important context. Confidence indicators are estimates, not guarantees. You are responsible for checking output before relying on it, publishing it, or using it to make a decision about another person.

Upenned intellectual property and feedback

The service, design, software, branding, and documentation belong to Upenned or its licensors and are protected by applicable law. These terms do not grant rights to use the Upenned name or branding. If you voluntarily provide product feedback, Upenned may use it without restriction or payment, but will not treat your private archive as product feedback.

Privacy

The Privacy Policy explains what information Upenned uses, how AI helps process letters, how information is protected and retained, and the choices available to you. By using the service, you direct Upenned to process uploaded material as described there.

Availability, changes, and suspension

Upenned may maintain, change, limit, or discontinue features and may temporarily pause processing when needed to operate the service responsibly. Existing archive access will be kept available when reasonably possible. Upenned may suspend or terminate access when reasonably necessary to protect users or the service, investigate misuse, comply with law, or enforce these terms. When practical, notice and an opportunity to export or correct the issue will be provided.

Deletion and account closure

You may delete letters or the account through the service. Active records are removed when deletion completes. An isolated backup that cannot be restored through the site is destroyed within 30 days as described in the Privacy Policy. Upenned may retain narrowly limited records where required by law or necessary for security or legal claims.

Disclaimers

To the extent permitted by law, Upenned is provided “as is” and “as available.” Upenned does not promise uninterrupted operation, permanent preservation, error-free AI output, or that the service will meet every archival requirement. Nothing in these terms excludes warranties, remedies, or consumer rights that applicable law does not allow to be excluded.

Limitation of liability

To the extent permitted by law, Upenned is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, goodwill, or data. Upenned's total liability arising from the service will not exceed the greater of $100 or the amount you paid Upenned during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited or to liability that cannot legally be limited.

Your responsibility for unlawful use

To the extent permitted by law, you are responsible for claims and reasonable costs caused by material you upload without the necessary rights or by your intentional violation of these terms. This does not require you to cover claims caused by Upenned's own misconduct or failure to use reasonable care.

Resolving concerns

Contact hello@upenned.com first so there is a fair opportunity to resolve a concern informally. Applicable law governs any unresolved dispute without waiving mandatory consumer protections or rights that apply where you live.

General terms and changes

If one provision is unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver. You may not transfer your account without consent; Upenned may transfer these terms with a legitimate transfer of the service. These terms and the Privacy Policy are the agreement concerning the service.

Material changes will be posted with a new effective date and, when appropriate, communicated before they apply. If you do not agree to a material change, stop using the service and delete or export your archive before the change takes effect.
